1. Agreement to Terms

By accessing or using AIFied (aified.online), operated by ATELIER KIDSCRAFT S.R.L. (CUI: 52105433, Romania), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including trial and paid subscribers.

2. Description of Service

AIFied is an AI-powered platform that provides:

• SEO, GEO, and AEO content creation and publishing
• Social media content generation and auto-posting
• Lead generation through social media monitoring
• AI-powered response generation in multiple languages
• Relationship CRM and intelligence reporting
• AI website builder

AIFied uses artificial intelligence to generate content and responses. While we strive for high quality, AI-generated content may occasionally contain inaccuracies. You are responsible for reviewing content before it is published, especially when using auto-post mode.

3. Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate, current information during registration
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• One person or company may create multiple accounts only if each is for a different business entity

4. Acceptable Use

You agree to use AIFied in compliance with all applicable laws and the terms of service of any social media platforms you connect. Specifically, you agree NOT to:

• Spam: Use AIFied to send unsolicited, repetitive, or irrelevant messages at scale
• Deceive: Generate content that intentionally misleads or deceives people
• Harass: Target individuals with unwanted, aggressive, or harmful messages
• Impersonate: Pretend to be someone else or misrepresent your identity
• Violate platform rules: Use AIFied in ways that violate the terms of service of Facebook, Instagram, LinkedIn, Reddit, X, TikTok, Pinterest, Threads, or Telegram
• Generate harmful content: Create content promoting violence, hatred, discrimination, illegal activities, or adult content
• Scrape excessively: Attempt to circumvent rate limits or platform restrictions
• Resell access: Resell, sublicense, or share your AIFied account credentials with third parties not covered by your plan

Violation of these terms may result in immediate account suspension or termination without refund.

5. Auto-Post Mode

AIFied offers an auto-post feature that publishes AI-generated responses automatically when confidence scores exceed your configured threshold.

• By enabling auto-post, you acknowledge that AI will post content on your behalf without individual approval
• You can undo auto-posted content within 24 hours via the Activity Log
• You remain fully responsible for all content posted from your accounts, whether manually approved or auto-posted
• You can switch between auto and manual mode at any time for any platform
• We recommend starting with manual mode and switching to auto only after reviewing AI quality

6. Subscription and Billing

6.1 Plans and Pricing

AIFied offers free and paid subscription plans. Current pricing is displayed on our pricing page. Prices may change with 30 days advance notice to existing subscribers.

6.2 Free Trial

Growth and Professional plans include a 7-day free trial. Agency and Enterprise plans do not include a free trial. A valid payment method is required at registration. If you cancel before the trial ends, you will not be charged.

6.3 Billing

• Paid subscriptions are billed monthly or annually, depending on your selection
• Annual subscriptions receive a 10% discount
• All prices are in Euros (EUR) and exclude applicable taxes (VAT)
• Payments are processed securely by Stripe. We do not store your credit card details
• Subscriptions renew automatically. You will receive an email reminder 2 days before each payment

6.4 Cancellation and Refunds

• You may cancel your subscription at any time from the Billing page
• Upon cancellation, you retain access until the end of your current billing period
• No refunds are provided for partial months or unused portions of your subscription
• No refunds are provided for annual subscriptions after the first 14 days

7. Intellectual Property

7.1 Your Content

You retain full ownership of all content you create, upload, or generate using AIFied. This includes blog articles, social posts, and responses. We do not claim any ownership over your content.

7.2 Our Platform

AIFied, including its design, code, AI models, algorithms, branding, and documentation, is our intellectual property. You may not copy, modify, reverse engineer, or create derivative works of the AIFied platform.

7.3 Feedback

If you provide suggestions, ideas, or feedback about AIFied, you grant us a non-exclusive, worldwide, royalty-free license to use that feedback to improve our platform.

8. Data and Privacy

Your use of AIFied is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using AIFied, you consent to the data practices described in the Privacy Policy.

9. Limitation of Liability

• AIFied is provided "as is" without warranties of any kind, express or implied
• We do not guarantee that AI-generated content will be error-free, appropriate, or effective for your specific needs
• We are not responsible for actions taken by social media platforms against your accounts (bans, restrictions, content removal) as a result of content posted through AIFied
• Our total liability for any claims related to the service is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages

10. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will notify users of planned maintenance when possible.

11. Account Termination

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in activity that harms other users, the platform, or third-party services
• Your account has been inactive for more than 12 months (free plans only)
• Required by law or a valid legal process

Upon termination, you may request an export of your data within 30 days.

12. Dispute Resolution

These terms are governed by the laws of the European Union. Any disputes shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the courts of competent jurisdiction in the EU member state where we are established.

13. Changes to Terms

We may update these Terms of Service. We will notify you of material changes via email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
