Terms of Service

1. The parties

1.2. You ("Subscriber", "User") — the person or legal entity registering an account on aified.online and accepting these Terms on their own behalf or on behalf of the organization they represent.

2. Definitions

• Service / Platform — the AIFied web application, the 10-agent AI fleet, and all APIs, endpoints, integrations and dashboards operated by us at aified.online.
• Fleet — the set of AI agents (Content Studio, Reddit Prospector, SEO Article, Keyword Hunter, PR Machine, Backlink Hunter, Community Engager, Lead Magnet Distributor, QA Guardian, Publisher) that draft and, where authorized, publish content on your behalf.
• Content — anything drafted, published or stored via the Service (posts, articles, replies, pitches, brand memory, comments).
• Brand memory — the persistent context (voice, target audience, banned words, founder story) each Fleet agent uses when drafting.
• Approvals — the queue where drafts wait for your review before publishing.
• Auto-publish — the mode in which the Service publishes drafts scoring ≥ your confidence threshold without asking you first.
• Third-party channel — LinkedIn, Facebook, Instagram, TikTok, Pinterest, Reddit, Bluesky, Telegram, Zernio, or any other platform where the Service posts on your behalf.

3. Account and access

3.1. To use the Service, register an account with a valid email address and a strong password. You must be at least 18 years old or a legal entity capable of contracting.

3.2. You are responsible for the security of your credentials. If you suspect unauthorized access, notify us immediately at hi@aified.online.

3.3. One person = one account. You may create additional "brand" contexts within your account under the Agency plan.

4. Subscription plans and pricing

4.1. AIFied is offered under three subscription tiers, billed monthly in EUR:

• Self-Publish — €49 / month. 1 brand · drafts only · you copy-paste to publish.
• Growth — €149 / month. 1 brand · full fleet · auto-publish at your configured confidence threshold. Includes a 7-day free trial for first-time subscribers, no credit card required until day 8.
• Agency — €449 / month. Unlimited brands · everything in Growth × N · per-brand isolation.

4.2. Prices exclude VAT where applicable. Romanian VAT (TVA 19%) is added at checkout for individuals in Romania. B2B customers with a valid EU VAT ID benefit from reverse-charge under EU rules.

4.3. Prices may change with 30 days' notice to your billing email. Existing subscribers keep their current price for the remainder of any prepaid period.

4.4. Payment is processed by Stripe. We do not store card details — Stripe is our PCI-compliant processor.

5. Free trial

5.1. The Growth plan includes a 7-day free trial. During the trial, all features are available.

5.2. You may cancel at any time during the trial with no charge.

5.3. On day 8, unless you cancel, you will be prompted for a payment method to continue on Growth. If no payment is provided, your account is downgraded to a read-only state — drafts remain but no new drafts are generated.

6. Cancellation and refunds

6.1. You may cancel at any time from Billing in your account. Cancellation takes effect at the end of the current billing period. You retain access until that date.

6.2. We do not issue pro-rated refunds for partial months, except where required by consumer protection law (14-day withdrawal right under Romanian law OG 34/2014 and EU Directive 2011/83, applicable to consumers only, not businesses).

6.3. To exercise the 14-day withdrawal right, email hi@aified.online within 14 days of first subscribing. Refunds are processed via Stripe within 14 days.

7. Acceptable use

7.1. You will not use the Service to create, draft, publish or distribute content that:

• is unlawful, defamatory, harassing, threatening, or infringes third-party rights (copyright, trademark, privacy);
• contains hate speech, incitement to violence, sexual content involving minors, or non-consensual explicit content;
• promotes malware, phishing, or fraud;
• violates the Terms of Service of any Third-party channel you connect (e.g., mass-posting on Reddit against subreddit rules, spam on LinkedIn);
• impersonates a person or organization you don't represent;
• misrepresents medical, legal, financial or safety advice as coming from a licensed professional when it is not.

7.2. AIFied includes a "QA Guardian" agent that blocks drafts violating hard rules before they leave the Fleet. This is a safety net, not a substitute for your review. You remain responsible for what is published.

7.3. We may suspend or terminate accounts that repeatedly violate section 7.1 without refund.

8. AI-generated content and ownership

8.1. All content drafted or published by the Fleet on your behalf is owned by you. You may use, modify, distribute, monetize and license it freely, without royalty.

8.2. We do not claim any copyright in AI outputs. We do not train foundation models on your Content, brand memory or drafts. We do not resell your Content.

8.3. AI-generated content is provided "as-is". Language models can produce inaccurate, offensive, or copyright-conflicting output. You are responsible for reviewing every draft before publishing — especially when auto-publish is enabled.

8.4. If you enable auto-publish at a confidence threshold (default ≥90%), you accept that drafts crossing that threshold will publish without human review. Rate limits and hourly caps apply, but you can turn auto-publish off at any time per platform in Settings.

9. Third-party integrations

9.1. The Service integrates with third-party channels (LinkedIn, Facebook, Instagram, TikTok, Pinterest, Reddit, Bluesky, Telegram, Zernio, Google Search Console, etc.). By connecting a third-party account, you authorize us to post, read or manage content on that account within the scope you grant.

9.2. Third-party services have their own terms. We are not responsible if a third-party channel disables your account, throttles, shadow-bans, or removes content you published through AIFied. Respect their ToS.

9.3. You may disconnect any third-party integration at any time from Settings. Doing so revokes the OAuth token — we lose ability to publish there immediately.

10. Fair use and resource limits

10.1. AIFied uses LLM providers (Google Gemini, OpenAI, Anthropic) under our commercial agreements. To keep the Service affordable for everyone, we enforce reasonable per-account limits on tokens, requests, and background jobs.

10.2. If you significantly exceed typical usage (e.g., 10× the median for your plan), we may throttle non-critical background jobs and contact you to discuss usage.

10.3. Bulk resale of the raw LLM API through AIFied (i.e., using us as an unbranded AI gateway) is prohibited.

11. Data processing and privacy

11.1. Personal data you provide is processed under our Privacy Policy. AIFied is the data controller for account data and a data processor for content you feed the Fleet.

11.2. B2B customers may request a Data Processing Agreement (DPA) meeting GDPR Art. 28 requirements. Email hi@aified.online.

11.3. Servers are located in the European Union (Hetzner Germany). We do not transfer personal data outside the EU/EEA except to sub-processors listed in the Privacy Policy under Standard Contractual Clauses.

12. Intellectual property

12.1. The AIFied name, logo, and Platform code are owned by ROLAXIT INNOVATION SRL. You receive a limited, non-exclusive, non-transferable license to use the Platform during your active subscription.

12.2. You may not copy, decompile, reverse-engineer, or resell the Platform, its agents, or its brand memory schema.

12.3. Feedback you send us (feature requests, bug reports) may be used to improve the Service without compensation.

13. Warranty and disclaimers

13.1. The Service is provided "as-is" and "as-available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

13.2. We do not guarantee:

• that AI-generated content will rank on Google, convert readers, or drive sales;
• that third-party channels will accept or amplify your posts;
• that the Service will be error-free or uninterrupted;
• that the Service will detect all off-brand or non-compliant drafts before you publish.

14. Limitation of liability

14.1. To the maximum extent permitted by law, our aggregate liability arising from or related to the Service is limited to the fees you paid us in the 12 months preceding the claim.

14.2. We are not liable for indirect, incidental, consequential, punitive or special damages — including lost profits, lost data, lost customers, or reputational harm — even if we were advised of the possibility.

14.3. Nothing in this section limits liability that cannot be limited under Romanian or EU law (e.g., gross negligence, willful misconduct, or violations of consumer protection law).

15. Indemnification

15.1. You will indemnify and hold us harmless from claims, damages, losses and expenses (including reasonable attorneys' fees) arising from Content you publish, your violation of these Terms, your violation of a third-party's rights, or your misuse of any third-party channel.

16. Termination

16.1. Either party may terminate the subscription at any time. Cancellation is effective at the end of the current billing period.

16.2. We may terminate or suspend your account immediately, without refund, if you materially breach these Terms (section 7 acceptable use, section 12 intellectual property, or non-payment).

16.3. Upon termination, your right to use the Service ends. We retain your data for 30 days for potential reactivation, then delete it (except as required by law).

17. Changes to these Terms

17.1. We may update these Terms occasionally. If a change is material (e.g., new limitation, new fee), we notify you via email at least 30 days in advance.

17.2. Continued use after the effective date constitutes acceptance. If you disagree, cancel your subscription before the change takes effect.

18. Governing law and dispute resolution

18.1. These Terms are governed by Romanian law. Any dispute arising from these Terms will first be attempted to be resolved amicably by contacting hi@aified.online.

18.2. If not resolved within 60 days, disputes are submitted to the exclusive jurisdiction of the competent courts of Bucharest, Romania.

18.3. Consumers may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

19. Miscellaneous

19.1. These Terms, together with our Privacy Policy and GDPR notice, constitute the entire agreement between you and us regarding the Service.

19.2. If any provision is held unenforceable, the remaining provisions remain in effect.

19.3. Our failure to enforce a right is not a waiver.

19.4. You may not assign these Terms without our prior written consent. We may assign them to a successor entity in the context of a merger, acquisition or sale of assets.
